Legal Notice
These general terms and conditions of sale (hereinafter referred to as "general terms and conditions of sale") govern the contractual relationship between, on the one hand, natural or legal persons wishing to make a purchase in the stores or on the website of Komut bikes, hereinafter referred to as "the Buyer", and, on the other hand, the company Cycle Home SRL (whose registered office is located at Rue Vanderkindere 395, 1180 Uccle - Tel.: +32 (0)2 725 63 92 - E-Mail:hello@komut.be- VAT BE 0771.412.591), hereinafter referred to as "Komut".
The publication manager is Mr. Alexandre le Grelle, Managing Director of Komut bikes.
1. Purpose and Scope
These general terms and conditions of sale stipulate the terms and conditions of sale between Komut and the Buyer. They apply to all sales of products offered both in physical stores / climbing stores / pop-up stores during events (hereinafter referred to as the "Stores") or on the online sales website of Komut (hereinafter referred to as the "Webshop"), whether the order has been placed physically, by telephone, by fax, by postal mail, by email, by direct messaging (chat) or via the Internet.
Any sale or order in the Stores and on the Webshop implies the Buyer's acknowledgment of these general terms and conditions of sale, prior to the sale, and the acceptance of their entire content by the Buyer. The acceptance of these general terms and conditions of sale takes effect upon the validation of the order by the Buyer. These general terms and conditions of sale are available in Stores, sent by email to each new customer who indicates their agreement (including in the case of modification) during each transaction; a link is also present at the bottom of each receipt, electronic ticket, and invoice referring to the general terms.
The applicable general terms and conditions of sale are those in force on the day of the validation of the order by the Buyer. Komut reserves the right to modify, at any time and without notice, the general terms and conditions of sale, the modifications then being applicable to all orders subsequent to this modification.
These general terms and conditions of sale prevail over any general terms and conditions of purchase submitted by the Buyer and cannot in any case be cancelled or repealed by the latter unless there is explicit agreement from both parties regarding the clauses subject to exception.
Any modification of the general terms and conditions of sale will be subject to a new agreement at each new purchase by the Buyer.
2. The Komut Bikes offer
2.1 Geographical coverage of the offer
The products are offered for sale by Komut in its Stores (located in Belgium) and on the Webshop. This last one delivers to most countries. The geographical coverage area of each sale may vary depending on the distribution agreements with each of the referenced suppliers, as well as the delivery methods. Komut may use filters on the site that will block orders coming from countries not covered by the offer. On a European scale, destinations requiring customs formalities are excluded such as the territory of Bàsingen, the island of Helgoland, Jersey, Guernsey, the Isle of Man, the territories of Campione d'Italia and Livigno, the Canary Islands, Ceuta, Melilla, the Faroe Islands, Greenland, Aland, Mount Athos and the northern part of Cyprus.
2.2 Stocks and availability
The products offered in Stores are available for sale immediately.
The products offered on the Webshop are accompanied by an exact availability time and an approximate delivery time. This information is updated regularly. A product marked "in stock" is present in Komut's own stocks. The actual availability of a product may vary quickly depending on the sales made on the Webshop or the stock of products with our suppliers (supply for certain products operates on a just-in-time basis).
Komut cannot be held responsible if the indicative time frame for the availability of the product(s) and their delivery is modified. In the event of a product being unavailable after the order has been placed, Komut commits to contacting the Buyer as soon as possible, by phone or by email. The Buyer may choose to maintain their order without the missing product (in the case of an order containing multiple products) or to cancel it. Komut will process the refund by crediting the bank account or payment method used no later than fourteen (14) days from the Buyer’s payment.
When an item is unavailable in our Stores and on the Webshop, the Buyer has the option to be notified of its availability by clicking on the button “Notify me when back in stock”. They are then asked to choose the model and leave their email to receive the notification of the item’s return to stock.
2.3 Orders, reservations, and holds
For all products not in stock in the Stores or on the Webshop, the Buyer has the option to place a reservation order, either directly in the Stores, or by phone, by email or by direct messaging (chat). The availability of this order may vary depending on the brand, the supplier or the existence of the item in another Komut Store. The customer will be informed of the approximate lead times when placing their order. If the ordered item is not part of the usual range followed by the Stores, Komut reserves the right to request a deposit of 50% to validate the order or may simply refuse the order. The Buyer must provide, at a minimum, their phone number and email address in order to place a reservation order. In the case of an order placed remotely (by phone, email or direct messaging), a payment link will be sent to the buyer by email, if the order requires a deposit. A reservation order can be sent directly to the Buyer’s home upon payment of the transport fees, regardless of the transaction amount.
If the lead times for reservation orders are deemed too significant and provided that the order with the Komut supplier is still cancellable, Komut may refund the deposit received from the Buyer upon simple request. If the order with the supplier is no longer cancellable, Komut reserves the right to retain 50% of the value of the deposit for a minimum of ten (10) euros, in order to cover the administrative costs incurred.
Upon receipt of a reservation order, the Buyer is notified primarily by SMS or by email. The Buyer has a period of seven (7) days to collect their order in Store. After this period, the item will be returned to the shelf and the reservation order will be cancelled. In the event that a deposit has been paid, Komut reserves the right to retain 50% of the value of the deposit for a minimum of ten (10) euros, in order to cover the administrative costs incurred. The same conditions apply in the event of the Buyer refusing to purchase the ordered item, exchanging or requesting a refund for this item. The price applied at the time of a reservation order will be that in effect on the day of purchase.
Komut also accepts the limited reservation of its items in stock. This service is only available in Stores and the maximum duration of a reservation is twenty-four (24) hours. A deposit may also be requested for a reservation, under the same conditions as reservation orders. The price applied at the time of a reservation will be that in effect on the day of the reservation.
2.4. Product characteristics
The products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions have occurred regarding this presentation, whether in Stores or on the Webshop, Komut's responsibility cannot be engaged. The photographs visible on the Webshop are not contractual.
2.5. Pricing policy
The prices of our products are indicated in euros, all Belgian taxes included, and are firm and final, in Stores and on the Webshop. They do not include shipping costs and other processing fees related to the Buyer's order, charged additionally and indicated before the validation of the Buyer's order. Komut reserves the right to change its prices at any time, without notice. The products will be billed to the Buyer based on the rates recorded at the time of order validation. We regularly carry out maintenance operations on our Webshop. This may generate pricing errors. In this case, the order cannot be fulfilled and we will contact you to cancel your order as soon as possible. The products remain the property of Komut until full payment.
2.5.1. Labels Komut
The products stamped “Label Komut” are guaranteed to have the best value for money in Belgium. They are generally associated with a price much lower than the recommended retail price. The conditions of the Label Komut apply only to products correctly indicated as such.
Current promotions do not apply to Labels Komut unless otherwise stated in Stores or on the Webshop. The Komut loyalty programme applies to the Labels Komut.
The Labels guarantee the lowest (or equal) price in Belgium (excluding promotions). If the Buyer finds one of the Komut Labels cheaper at another retailer, they simply need to provide proof of the price difference. This can take various forms: a photo, a screenshot, etc. The Buyer must send this proof to the address komut@komut.be with the necessary details (not forgetting their proof of purchase, if the product has already been bought). Komut will verify that the price difference meets the conditions of the Komut Label. If the Buyer has already purchased the product, Komut will refund the difference in the form of vouchers valid for 1 year in all our Stores or on our Webshop. Komut will automatically adjust the new price across all its sales platforms.
The application of the lowest price guarantee is only valid for retailers located in Belgium and sales on websites with an operational base in Belgium.
Promotions and any other time-limited price reductions will not be taken into account in the lowest price guarantee. Any sign that could suggest a promotion (crossed-out price, time limit, etc.) will be considered when evaluating the Buyer's refund request.
Irrefutable proof must be attached to the refund request for price difference (photos, screenshot, etc.). Komut reserves the right to validate the proof.
The Buyer has thirty (30) days from the date of their purchase to notify Komut of the price difference. After this period, no refund request will be accepted.
2.5.2. Sales and promotions
Promotions are clearly indicated in the Stores and on the Webshop by means of specific signage. This is generally accompanied by a percentage discount and the new price applied. During general promotions, it is possible, in Stores, that the product labels are not modified; the discount will apply, in any case, automatically at the checkout.
Promotions are mostly time-limited. They may also be linked to the end of a collection or the end of seasonal products. Promotions are exchangeable or refundable, according to the terms explained further on (unless stated otherwise).
When starting a temporary promotion, we offer our customers the opportunity to still benefit from this promotion if their purchases were made within the three (3) working days preceding the start of the temporary promotion. The refund of the difference will be made in the form of a credit applied to the customer's account which they can use for a future purchase. Just send an email to hello@komut.be to assert this right.
For BOGO type promotions (Buy One Get One - e.g.: 50% off the second product purchased), any refund must be made on all products included in the promotion or the benefit received during this promotion will be deducted from the product refunded when requesting a refund.
Sales take place in January and July. The return policy on sale items or end-of-life products is the same as for a normal promotion: 30 days return right.
2.5.3. Rates and special conditions
The Buyer may exceptionally benefit from special rates or conditions within the Komut Stores. These advantages are, for the most part, governed by agreements and specific conventions, and are only valid in Stores currently (and not on the Webshop).
These advantages cannot be combined with other promotions or actions offered by Komut and are strictly personal.
2.6. Export orders and customs duties
Any order shipped outside the European Union will be charged excluding tax at the request of the Buyer. They can make this request immediately after their purchase by email or via direct messaging. The amount of the tax collected will be immediately refunded to them and their invoice adjusted. The import formalities, customs duties and any applicable taxes related to the delivery of an item outside the European Union are the responsibility of the Buyer. They must be paid to the competent authorities of the country of delivery. The Buyer is solely responsible for verifying the import possibilities of the ordered products in accordance with the law of the country of delivery. Komut is not obliged to verify and inform the Buyer of the applicable customs duties and taxes. To know them, Komut advises the Buyer to check with the competent authorities of their country. By ordering on the Webshop, the Buyer is considered the official importer and is required to comply with all laws and regulations of the country where they will receive the goods. Cross-border deliveries may be subject to an opening and inspection procedure by customs authorities.
2.7. Embassies and export VAT
If the Buyer makes a purchase in our Stores with the aim of exporting it outside the European Union, they are entitled to request a VAT refund from Komut. To this end, the Buyer must prove that the product has indeed been exported.
- The Buyer must request an invoice at the time of the sale of the goods
- The Buyer must ask the competent customs service to stamp the invoice in question
- The Buyer must provide Komut with a copy of the invoice with the customs stamp, as well as their complete bank details to process the refund.
Regarding the purchases of diplomats in our Stores, they also benefit from the right to recover the VAT charged in two ways:
- either directly at the checkout, at the time of their purchase by presenting their Diplomatic Card and following the procedure described on the site https://diplomaticcard.be/
- or by going through the designated bodies for this purpose.
Komut reserves the right to process the VAT refund within fourteen (14) days of receiving the invoice in order.
2.8. Equipment rental service
The Tenant is fully aware that certain risks are inherent in outdoor sports, risks that can never be passed on to the equipment or Komut. By signing the rental agreement, the Tenant declares that they have provided correct data regarding the rental that has allowed Komut to make the correct adjustments. The Tenant acknowledges having checked the settings upon receipt of the equipment. They have acknowledged these general terms and conditions.
2.8.1. Rental period
The rental begins at the moment when the Tenant or their representative receives the rented equipment/bike from the lessor at our Stores. The Tenant who neglects to collect or receive the rented equipment at the agreed time remains, however, bound by the rental contract for the agreed duration or for a duration that is at least equal to that which they indicated as the presumed duration of the rental. All this is without prejudice to any potential compensation. The promises of Komut regarding the delivery date do not bind them and are not a reason for termination of the agreement, nor for compensation.
The rental ends, if it has been expressly made for a fixed period, on the agreed date, without Komut being able to invoke tacit extension.
As soon as the rental period is over, the Tenant is deemed, by operation of law and without any formal notice, to be obliged to return the rented item. Komut has the right, from that moment on, to have the rented equipment returned without having to go to court, regardless of where the equipment is located. All costs such as disassembly, loading, transport, unloading, etc. are entirely the responsibility of the Tenant. For each day of delay in the return of the rented equipment, the Tenant will owe compensation equal to 30% of the rental price per week, Komut reserving the right to demand additional compensation.
The attention of the Tenant is drawn to the fact that they can never become the owner of the rented equipment and that their failure to return it at the agreed time indicated above is punishable as a breach of trust.
2.8.2. Risks and perils
The Tenant bears, for the entire rental period, and therefore also during the transport to and from, the burden of the risks and perils related to the loss, theft and deterioration of the rented equipment.
Komut provides goods in good condition. The inspection and counting by the Tenant always take place in the Komut Stores. The Tenant is required to immediately ensure, upon receipt of the rented goods, the correct number and the good condition of the goods. Any claims must be noted on the rental form to be kept by Komut, failing which all claims against Komut will be null and void. The collection and receipt by the Tenant or their representative constitutes tacit and irrevocable acceptance. Any sub-letting is prohibited, unless prior written agreement from Komut.
The Tenant is responsible for returning the equipment in the same condition and in the same quantity. Without prejudice to their recourse against third parties, the Tenant is responsible for any loss, damage, difference, depreciation, etc. in the broadest sense of the term, without being able to invoke against Komut the fault or intention of third parties, chance or force majeure.
The Tenant is also responsible, for the entire duration of the rental, for any damage or nuisance that the rented item, or its use, even if not faulty, may cause to third parties. They will indemnify and hold Komut harmless in terms of liability for damage occurring to third parties, caused by, or in connection with, the rented goods or their use, or caused as a result of any defect whatsoever and occurring at any time to the goods.
2.8.3. Rent and payment terms
All prices indicated, as agreed in the rental form, applies to a single use during the agreed period. No discount is granted if the actual duration of use is shorter than the flat rate duration. If the actual duration of use exceeds the flat rate duration, the rent will be increased pro rata for the additional days. The collection of goods for rentals starting from the weekend is possible from Thursday noon.
Payments are made at the operating headquarters of Komut (the Stores) or on its Webshop. The full payment will be requested and settled at the time of handing over the goods rented.
2.8.4. Caution
The security deposit is intended to guarantee the obligations of the Tenant. It must be paid before the collection of the rented equipment. It can never be considered as a deposit on the rental and will only be returned to the Tenant after it has been established that the Tenant has fulfilled all their obligations. The guarantee never accrues interest.
2.8.5. Guidelines for use
By recalling what has been agreed under point 2.8.2 and without this statement being considered complete, the Tenant's attention is drawn to the obligation they must comply with, given the nature and type of the rented property, namely to protect the rented property against excessive constraints and damage, and to use the rented property as a good father of a family.
2.8.6. Miscellaneous provisions
If repair work becomes necessary due to normal wear and tear, the Tenant must immediately inform Komut. Komut will then carry out the work itself or have it carried out at its own expense by third parties, at no cost to the Tenant. The time required for maintenance, upkeep and any necessary repair work is included in the rental period, unless it involves repair work that has become necessary due to normal wear and tear. However, the Tenant has no right to compensation based on any interruption of the use of the rented property and cannot, in this case, claim a right of termination of the rental agreement. The Tenant cannot carry out or have repair work carried out themselves, but must communicate any work to be done to Komut. Work that becomes necessary due to inappropriate use or lack of diligence by the Tenant, or due to force majeure or actions of third parties must be paid for by the Tenant without prejudice to the fact that subletting or lending to third parties is excluded.
Komut is not responsible for damages occurring to the Tenant and resulting from non-performance, late performance or improper performance of any obligation arising from these rental conditions, unless the cause of the non-performance, late performance or improper performance lies in negligence or gross fault of Komut acting itself or with the assistance of its legal representatives.
The Tenant is responsible for all damages, whatever they may be, occurring in the name of Komut and arising from non-performance, late performance or improper performance of any obligation arising for him from these rental conditions, regardless of the cause of the non-performance, late performance or improper performance. As far as it concerns damages caused to the rented goods themselves, the value of the rented goods is equivalent to the new value.
Komut is not responsible for damages occurring in the name of the Tenant due to any defect whatsoever and occurring at any time to the rented goods.
The provisions of these rental conditions may only be deviated from if this is expressly stated in a communication on the rental voucher.
For the adjustment of the rented skis, Komut will use the most current standard or norm. This standard will always take into account the gender, weight, shoe size and level of the skier.
2.8.7. Competence
All disputes related to the rental are the exclusive jurisdiction of the courts and tribunals of Brussels.
2.8.8. Cancellation of the rental
Up to one month before the rental period, the rental can be cancelled and will be fully refunded.
Less than one month before the rental period, cancellation is no longer allowed and no refund will be made.
In the case of a medical certificate for a period of incapacity dating from BEFORE the start of the rental period (up to and including the moment of returning the equipment), cancellation will be possible and a full refund will be made.
NO refund can take place in the case of a medical certificate for a period of incapacity after the start of the rental period.
2.8.9. Billing of costs in the event of loss or irreparable damage
When the Tenant does not return the rented equipment because it has been stolen or lost, or if he returns the damaged equipment, so that it can no longer be rented out, charges will be billed to the Tenant. A portion of these charges will be settled by withholding the deposit paid by the Tenant. Any remaining balance must be paid additionally by the Tenant.
2.9. Repair service
Komut offers a repair service based on its skills.
2.9.1. Minor repairs and supplier repairs
Komut offers a small repair service for various equipment (tents, sleeping bags, mattresses, etc…) in Stores. Upon the Buyer’s request, a quote will be prepared if Komut deems it possible to repair the Buyer’s equipment in-house.
Komut can also request a quote from certain suppliers to repair equipment out of warranty. Upon the Buyer’s request, Komut will contact the supplier to establish a quote which will then be submitted to the Buyer for acceptance. If the Buyer accepts it, the equipment is sent to the supplier at the Buyer’s expense.
The buyer must provide his complete contact details (postal address, phone, email), must pay the full service fee and receives a work order with a reference number. Repairs take between 4 and 6 weeks depending on the suppliers.
Upon the return or completion of the repair, the buyer is notified primarily by SMS or by email that he can come and collect his repaired equipment. Komut holds the item for a maximum of 60 days after the buyer has been notified (unless otherwise stated when ordering the repair).
2.10. Vouchers, promotional codes, partner discounts, and gift cards
2.10.1. Vouchers
Komut issues vouchers occasionally either for its partners or for specific events. These vouchers are considered as full means of payment in the Stores and the amount of these is deducted from the total sale price to the Buyer.
The Buyer will strictly follow the terms of use of the voucher indicated on it. The use of a voucher may be subject to a minimum purchase and an expiry date.
Vouchers (unless stated otherwise) are only valid in the Stores. A voucher is never cumulative.
2.10.2. Promotional codes
Komut occasionally shares promotional codes on its various distribution channels. These codes are only valid on the Webshop and are, for the most part, accompanied by clearly stated terms of use when shared.
2.10.3. Komut gift cards
The Buyer has the option to purchase gift vouchers in Stores or on the Webshop.
The Komut gift card can be used in one or more transactions in the Stores. It is valid for 12 months from its date of issue. The balance and the expiry date are indicated on the envelope that the Buyer receives with it and can also be requested in the Stores. The general terms of use and the list of Komut stores are available on the Webshop.
Gift cards purchased in Stores are usable exclusively in-store: present the gift card at the checkout and complete, if necessary, with a means of payment of your choice accepted in your Komut store.
The gift cards purchased on the Webshop are valid in Stores and on the Webshop. For purchases in Stores, they will be used upon presentation at the checkout of the code received by e-mail, duly completed if applicable. Once the gift card is used, even partially, in-store, it will be deactivated from the Webshop. In case of use on the Webshop: enter the code received in the field provided for this purpose during the virtual checkout. Once the gift card is used, even partially, on the Webshop, it will be deactivated in Stores.
This gift card cannot be exchanged or refunded, even partially, nor credited to a card or bank account or another gift card, nor be subject to a discount and cannot result in any change being given. It is neither replaced nor refunded in case of loss or theft.
2.10.4. Partner discounts
Komut negotiates annual partnerships with several partners. These partnerships usually include benefits for members and different entities of the partner in the Stores.
Each partnership being different, it is the responsibility of the partner to correctly communicate, to its members and entities, the different benefits to which they are entitled in the Stores.
The benefits granted by Komut partnerships are only valid in Stores unless specifically stated otherwise. Members and entities must present an up-to-date and irrefutable proof that they are indeed a member or an entity of the partner. Komut reserves the right to accept or reject the proof presented.
The discounts granted to our various partners and their members are never cumulative and always apply to the full price of the product practiced in the Stores.
2.11. Customer account
During the first visit of the Buyer in Stores, Komut offers to create a customer account. The Komut customer account entitles the holder to several benefits :
- Access to the Komut loyalty programme
- Preserve the customer's sales history and ensure the validity of warranties on purchased products.
- Notify him when special orders are available.
- Offer him access to rental services, resoling, etc.
To create a customer account in Stores, the Buyer must at minimum provide his First Name, Last Name, email address (mandatory for the loyalty programme) and phone number. He will also be asked to share his postal address and any information useful for the proper implementation of his customer account. By creating his account, the Buyer accepts the general terms and any subsequent modifications that will be notified to him. If he continues to use his account after such notification, he is presumed to accept the new general terms.
In case of orders on the Webshop, the Buyer may also choose to create a customer account. He will need to provide the same details as in Stores. His account will be automatically synchronised with the Stores.
Following the creation of their customer account, the Buyer will receive a unique e-mail welcoming them and outlining the various benefits of their customer account, the loyalty programme, the sharing of these general terms and conditions of sale, the proposal to create an account on the Webshop to synchronise their data, and the possibility to subscribe to various commercial e-mails from Komut. The Buyer will also be automatically signed up for updates on their loyalty programme which they will receive by e-mail. The Buyer will not receive any other e-mails from Komut unless they choose to. They can unsubscribe from the mailing lists at any time.
The conditions for processing the personal data of the Buyer are outlined in the privacy policy of Komut provided to the Buyer and available on the Site and in Store, which forms an integral part of these.
2.12. Requests for invoices
The Buyer can, at any time, request an invoice for purchases made at Komut. They must have a customer account to access the invoicing service.
In Stores, the Buyer can request an invoice directly at the checkout during their purchase. They will need to provide the minimum legal details required to issue an invoice (first name and surname, company - if applicable, VAT number - if applicable, postal address). The invoice can be printed directly in Stores or sent to them by e-mail upon request. The same applies to receipts.
On the Webshop, if the Buyer needs an invoice, they can enter their VAT number and download it from their customer account or from the status page of their order.
2.13. Komut Loyalty Programs
The Komut loyalty programme allows the Buyer to accumulate points that they can exchange for loyalty discounts or rewards in Stores and on the Webshop.
2.13.1. Earning points
You earn loyalty points by making purchases of items in our Stores and on our Webshop based on the principle: One (1) euro spent = One (1) loyalty point. Services do not generate loyalty points.
2.13.2. General information
Anyone who registers as a customer by sharing their email address on the Webshop or in the Stores has access to the basic loyalty programme of Komut. Points remain valid as long as there is no inactivity of more than one year on the various sales platforms and/or the different ways to accumulate points.
Once registered in the loyalty programme, the Buyer will periodically receive information by email about their points balance (they can unsubscribe from these notifications at any time). If the Buyer is subscribed to the Komut mailing list, a status of their points is also available at the bottom of each email that Komut sends. Finally, the Buyer can check their points by logging into the Webshop.
The e-mail address shared in Stores must be the same as that of the account created on the Webshop in order to enjoy the benefits across all platforms. The support service can be contacted if a problem arises, at the following address hello@komut.be.
2.13.3. Dépenser des points
The buyer can spend their loyalty points for discounts to pay in full or in part for their purchases. Payment in Stores is made in the form of a direct discount at the checkout upon the buyer’s request. Payment on the Webshop is done through promotional codes generated by the buyer and usable for 1 year after their issuance.
Only one loyalty discount can be used when making a purchase. No accumulation will be possible.
The loyalty discounts are:
- 200 points = €10 discount
- 500 points = €25 discount
- 1000 points = €50 discount
- 2000 points = €100 discount
Other rewards can be obtained occasionally by spending points.
3. Usage precautions
3.1. Conditions for purchasing in-store or placing an order
The buyer must have legal capacity or, if they are a minor, be the holder of parental authorisation allowing them to purchase in stores or place an order on the webshop.
3.2. Ordering process
3.2.1. In-store
In-store service is self-service. The sales advisors are available to assist the buyer in their choices. Payment is made at the checkout of the stores.
3.2.2. On the webshop
- Selection of items and adding to basket
- Validation of basket contents
- Identification on the site if the customer is not already identified (optional)
- Choice of delivery method
- Choice of payment method and acceptance of the T&Cs
- Payment validation
The Buyer can place their order online via the Webshop. The data provided by the Buyer and recorded by Komut at the time of the order constitutes proof of the transactions between Komut and the Buyer. The validation click after filling out the order form constitutes confirmation of the Buyer's order, and an obligation to pay. This validation click serves as proof that engages the customer in a ordering process and definitively validates their order. This click will constitute irrevocable acceptance of the General Terms and Conditions of Sale as well as the Privacy Policy of Komut. The conclusion of the contract will only be effective after sending a confirmation email of the registration of the order by Komut. Komut reserves the right to refuse delivery or to honour an order in cases where the Buyer has not fully or partially settled a previous order, or in the case where a payment dispute remains.
3.2.3. Remotely
Komut offers the possibility to place orders by phone, email, direct messaging. If the products are available on the Webshop, the Buyer will receive a notification of an order pending payment which they can settle via the link provided in the order notification.
In the event that the items are not available on the Webshop but are available in stores, Komut will send a payment link via the Plink platform with a pro forma invoice so that the Buyer can settle their order. Once the order is paid, it will follow the standard delivery procedure.
3.3. Processing of the order via the webshop or remotely
Any order placed before 12pm from Monday to Friday (excluding public holidays) is prepared and dispatched on the same day if all products are indicated as in stock and present in the main stock of our warehouse in Brussels, subject to payment validation. In the event that one or more items need to be transferred, the delivery time will be slightly delayed. The indicative times present on the Webshop take this possibility into account. Orders placed during the weekend are processed on the first working day following. Delivery times are understood from the collection of parcels from the warehouse. The logistics service operates only on weekdays.
4. Payment
Komut offers different types of payment in Stores and on the Webshop. A currency converter is available on the Webshop but all transactions are made in euros. Payment of the full price is due at the time of order by the Buyer who agrees to pay the stipulated price for the item(s) ordered including the price of the items, as well as the shipping costs and any other processing fees for the order.
As part of the fight against online fraud, Komut reserves the right to request a photocopy of the identity card and a proof of address for any payment.
4.1 Payment terms
Payment for orders is made online, at the time of order validation, via the following means:
- Credit card (Visa, MasterCard, Maestro, American Express)
- Bancontact
Transactions are fully secured thanks to our payment partner Mollie. No banking information is stored on our site.
The order will be confirmed upon payment validation. Komut Bikes reserves the right to refuse an order in case of non-payment or suspicion of fraud.
4.1. Cash payment (in-store only)
Cash payment only in euros is possible in our Stores. The total amount to be paid in cash is rounded to the nearest 0 or 5 cents, depending on the case, either downwards or upwards.
- If the total amount to be paid in cash ends with 1 or 2 cents, it is rounded down to x,x0 euro.
- If the total amount to be paid in cash ends with 3, 4, 6 or 7 cents, it is rounded to x,x5 euro.
- If the total amount to be paid in cash ends with 8 or 9 cents, it is rounded up to x,(x+1)0 euro.
Maximum cash payments are limited in accordance with Belgian legislation. Komut has limited cash funds in store, so it is possible that certain notes may be refused at the beginning of the day or if the availability of cash is insufficient to ensure change.
4.2. Payment by bank card (in-store, online shop, and remotely)
Only payment by one of the following bank cards will be accepted: Bancontact, Visa, Mastercard, American Express. The card will be debited at the time of order or sale confirmation. The Buyer guarantees to Komut that they have any necessary authorisations to use the card payment method when placing the order. Komut takes all necessary measures to ensure the security and confidentiality of the data transmitted on the Webshop and in Stores (including online payment, under the conditions stated in the Privacy Policy).
The Buyer also has the option to use contactless payment and the Payconiq service in Stores.
4.3. Payment via eco-vouchers, meal vouchers, compliment vouchers, or gift passes (in-store only)
Compliment and gift vouchers are accepted on the entirety of the Komut assortment.
4.4. Payment via Komut gift voucher (store and webshop)
The Buyer can use a Komut gift voucher purchased on the Webshop or in the Stores to make purchases in Stores.
Gift vouchers issued from the Webshop are also valid on it unless they have been partially used in Stores.
Gift vouchers issued from the Stores are only valid in Stores.
4.5. Payment using a loyalty discount (stores and webshop)
In accordance with the Komut loyalty programme, the Buyer can spend their loyalty points for discounts to pay in full or in part for their orders.
Payment in Stores is made in the form of a direct discount at the checkout upon the Buyer’s request.
Payment on the Webshop is made through promotional codes generated by the Buyer and usable for 1 year after their issue.
Only one loyalty discount can be used per purchase. No accumulation will be possible.
5. Delivery
Products are delivered to the delivery address mentioned during the ordering process or when contacting via eligible channels for distance ordering. In case of an error in the wording of the details, Komut cannot be held responsible for the impossibility of delivery. In this case, the costs incurred for a new delivery will be borne by the Buyer and charged at their actual cost.
Komut is committed to making its best efforts to ensure that the delivery of the ordered items is carried out as quickly as possible according to the chosen delivery method and the availability of the items. The delivery times indicated on the Webshop are average usual times and correspond to the total processing and shipping time. In the case of ordering several products at the same time and the shipping times are different, the actual shipping time may be the longest time, the entire order being prepared when all the products that make it up are in stock at Komut.
Delivery is deemed to have taken place upon handing over the product to the Buyer or their representative.
5.1 Delivery terms
Deliveries are currently limited to the Belgium, the France, the Luxembourg and the Germany, to the delivery address provided by the BUYER at the time of ordering (P.O. boxes are excluded).
It is the responsibility of the BUYER to ensure that the provided address is correct and accessible. Komut Bikes reserves the right to refuse an order in the case of an invalid address or an area not covered by our delivery service.
5.2. Execution Terms
Once the payment is validated, the order is processed within 1 to 3 working days. The products are then shipped to the address provided by the BUYER at the time of ordering.
The delivery times indicated at the time of ordering are given as a guideline. Komut is committed to making its best efforts to meet these times.
Delivery times generally vary between 1 and 5 working days for an address located in Belgium. A confirmation email containing tracking information will be sent as soon as the shipment is dispatched.
In the event of a significant delay, the Buyer will be informed as soon as possible.
If the delay exceeds thirty (30) calendar days after the order confirmation, the Buyer may request the cancellation of the order and obtain a full refund of the amounts paid.
In the case of a customised or made-to-order product, an additional delay may apply. This information is specified on the relevant product sheet.
Komut Bikes cannot be held responsible for a delay due to an address error, a case of force majeure, or an event beyond its control (strike, transport issue, etc.).
5.1. Checking the condition of the parcel upon delivery
Komut recommends that the Buyer check the condition of the package and its contents at the time of delivery, in the presence of the carrier, to ensure the order's compliance.
In the event of an apparent anomaly (damaged package, missing product, reference error, etc.), the Buyer is invited to:
- issue precise, dated, and signed handwritten reservations on the delivery note or the carrier's terminal, and to keep a copy;
- inform Komut as soon as possible, ideally within 10 working days following receipt, in order to allow for a quick processing of the case.
This verification upon receipt does not in any way limit the legal rights of the Buyer in the matter of conformity guarantee or hidden defect.
In accordance with the Economic Law Code, the Buyer has a period of two (2) months from the discovery of a defect to report it to Komut.
5.2. Delay in delivery
Komut is committed to doing everything possible to ensure the delivery of products within the agreed deadlines.
En cas de retard de livraison ou de colis égaré, l’Acheteur est invité à en informer Komut par e-mail (hello@komut.be) or by phone (+32 (0)2 725 63 92). Komut will take all necessary measures with the carrier to locate or replace the order as soon as possible.
In accordance with Article VI.44 of the Economic Law Code, the risk of loss or damage to the goods is borne by Komut until the product is actually received by the Buyer.
In the event of non-delivery within the agreed deadlines, the Buyer may cancel the order and obtain a full refund of the amounts paid.
5.3. Delivery in the event of absence
In the event of the recipient's absence at the time of delivery, the carrier will leave a delivery notice at the address provided by the Buyer. The order must be collected at the address and according to the terms indicated by the carrier. If not collected within the time limits set by the carrier, the order will be returned to Komut, which reserves the right to refund the price, with shipping and return costs remaining the responsibility of the Buyer.
5.4. Delivery to pickup points
Komut offers the possibility to have delivered to a collection point in Belgium and in certain countries via bPost and DPD. The Buyer is notified once the parcel is available for collection. The parcel remains available for 14 days. In case of non-collection within the time limits set by the carrier, the order will be returned to Komut, which reserves the right to refund the price, with the shipping and return costs remaining the responsibility of the Buyer.
5.5 In-store pickup
Products ordered on the Komut Webshop can be collected in the Stores (Uccle, Ixelles or Saint-Gilles). This collection method can be selected via the cart page in the checkout tunnel. An email is sent to the Buyer when the parcel is ready to be collected from the warehouses. This time may vary depending on the availability of the products. To collect the product, the Buyer simply needs to bring their order number as well as an identification document. The parcel remains available for 14 days in your collection store. In the event that the Buyer cannot come to collect their order themselves, the person supposed to collect the parcel on their behalf must bring the identification document (original or copy) of the Buyer.
6. Right of withdrawal, refund or exchange
6.1. Conditions for exercising the right of withdrawal
The Right of Withdrawal is considered to be correctly applied in the case where the following conditions are fully respected:
- Deadline
In accordance with the Belgian Economic Law Code, the Buyer has a period of fourteen (14) calendar days to notify Komut of their decision to withdraw, starting from the day after receipt of their order. This withdrawal can be exercised without having to justify a reason or pay penalties, except for return costs, which remain the responsibility of the Buyer for discounted product Webshop orders as well as export orders.
As soon as Komut is informed of the withdrawal decision, the Buyer has a new period of fourteen (14) calendar days to return the relevant product(s).
In the case of postal returns, return costs are free for Belgium. For other countries, the applicable shipping charges will apply.
For items purchased on the Webshop, after contacting the customer service, the Buyer has a period of thirty (30) clear days to return the goods in their original condition.
The period starts from the date of receipt of the product. It is understood in calendar days.

- Condition of the product
The product must be returned complete, undamaged, and properly protected to avoid any deterioration during transport.
It is recommended to use the original packaging when it is still available, or any other packaging providing equivalent protection.
The product must be accompanied by all its accessories, the user manual and any documentation provided at the time of purchase.
The consumer may handle the item to the extent necessary to establish its nature, the characteristics and the proper functioning, as they would in a shop. However, Komut reserves the right to refuse a full or partial refund if the product has suffered a depreciation resulting from excessive handling.
6.2 Handling of complaints
L’ACHETEUR dispose d’un droit de réclamation en cas de produit non conforme, défectueux ou endommagé à la réception.
Any complaint can be sent by email to hello@komut.be, specifying the following information:
- the order number ;
- a detailed description of the problem ;
- supporting photos, if necessary.
Komut recommends reporting any issue as soon as possible, in order to facilitate the processing of the case.
In accordance with the Economic Law Code, the Buyer has a legal period of two (2) months from the discovery of the defect to notify their complaint.
Our team is committed to processing each request within a 48 working hours.
Depending on the situation, an appropriate solution will be proposed: replacement, repair, credit or refund.

6.2. Return procedure
The Buyer can directly exchange their product in one of the Komut Stores completely free of charge, regardless of where it was purchased.
The Buyer can also contact Komut's customer service by e-mail at hello@komut.be, via phone or direct messaging. Komut will indicate the procedure to follow for making the return. The return of a Webshop order can also be done via the designated return portal: https://komut.shipping-portal.com/
Returns in Stores are accepted (Ixelles, Uccle & Saint-Gilles) with the purchase receipt, or without a receipt if the purchase was made from a customer account, and if the product is in the same original condition.
The return is made under the full responsibility of the Buyer and any risk related to the return of the goods (deterioration, theft, breakage) remains with the Buyer.
Returns of goods with postage due will not be accepted.
Komut cannot be held responsible for problems encountered following returns via letterbox (misuse of the service, theft of parcels in the letterbox, breakage, ...)
Upon receipt of your returned parcel, Komut checks the compliance of the return. No return will be accepted if the returned products have been visibly used or damaged by the Buyer and that this use or damage renders the products unsaleable. If the return cannot be accepted, Komut will contact the Buyer regarding the terms of returning the products at the Buyer's expense.
6.3. Processing the return
Subject to acceptance, Komut will offer:
- The credit note
When returning in-store, the Buyer can choose to add the value of their return as a credit note to their customer account. This credit note remains available on the Buyer's account for a period of one year.
- Refund or exchange
The refund for purchases can be made either in-store (in cash) or, in the case of a purchase on the Webshop, directly to the original payment method if possible.
In the case of an online refund, Komut will refund the Buyer as soon as possible and no later than fourteen (14) days following the receipt of the customer's withdrawal decision, minus any return shipping costs.
Returns are only free for Belgium. For returns from France, Luxembourg and the Netherlands, the return costs can be paid directly via our return portal.
For all other countries, (including France, Luxembourg and the Netherlands, if the Buyer chooses not to use our return portal), the Buyer must send the package at their own expense using the delivery service of their choice, to the following address:

The Buyer must include the order form or the invoice in the package. Packages remain under the responsibility of the Buyer until the package is delivered to our warehouse.
The refund will be made to the billing address registered at the time of the order, via the payment method used for the settlement, where possible. The shipping costs paid for the initial sending of the goods, when they have been correctly delivered and received by the Buyer, are never refunded, except in the case of a defect found on the delivered products.
Komut offers an exchange guarantee as a commercial gesture. The Buyer can exchange an unused item within 30 days upon presentation of their receipt.
No item will be accepted if it is not returned in a new condition and in its original packaging, or if it has been used. No signs of wear will be accepted. Komut reserves the right not to offer these commercial gestures if the conditions are not met.
In order to exercise a right of withdrawal, it is required to also return to Komut the items offered at the time of purchase of the returned item, as part of a promotional operation.
7. Service After-sales / Legal warranty
7.1. Contractual warranty
The Buyer benefits from the warranty provided by the different manufacturers of each product free of charge. Komut cannot be held responsible for improper use and/or intensive use of the items that the customer may make.
7.1.1. In-store after-sales service
- The Buyer can return their defective products under warranty to the Stores in Ixelles and Waterloo.
- When dropping off the product, ensure that it is clean, with no personal items in the pockets, and without soles or laces.
- The Buyer must always bring the proof of purchase of this item to claim the warranty from a supplier. If the Buyer has created a customer account in-store, Komut can retrieve this proof of purchase.
- Komut examines the product and gives a first opinion regarding the warranty.
- According to the Buyer’s decision, Komut forwards the details to the brand to claim the warranty.
- The brand carries out a detailed assessment of the product for potential warranty coverage. It ensures that the defect does not arise from abnormal use of the product.
- Komut informs the Buyer of the decision made by the brand.
Komut follows the brand's policy in the case of warranty coverage. If the brand repairs or exchanges the product, the product will be available for collection at the store where it was dropped off and the Buyer will be notified. If the brand issues a credit note to Komut, Komut will issue a credit note for use in the Stores and in no case a refund.
7.1.2. Webshop after-sales service
The after-sales service on the Webshop is similar to that in store.
- Komut requests the sending of a photo even if the defect is not apparent and a precise description of the problem by email to the address hello@komut.be as well as the reference to the order number.
- Komut sends the Buyer an return label by email to attach to their shipment.
- The Buyer sends the clean product accompanied by the return document and a copy of the purchase invoice. The return costs are the responsibility of the Buyer.
- Upon receipt of the package, Komut forwards everything to the brand.
- The brand carries out a detailed assessment of the product for potential warranty coverage. It ensures that the defect does not arise from abnormal use of the product.
- Komut informs the Buyer of the decision made by the brand.
Komut follows the brand's policy in the case of warranty coverage. If the brand repairs or exchanges the product, the product will be available for collection at the store where it was dropped off and the Buyer will be notified. If the brand issues a credit note to Komut, Komut will issue a credit note for use in the Stores and in no case a refund.
7.2. Statutory warranties
All products offered by Komut are subject to the application of Belgian legal warranties of conformity and hidden defects, in accordance with articles 1649bis and following of the Civil Code and the Book VI of the Economic Law Code.

7.2.1. Legal guarantee of conformity
As part of the legal guarantee of conformity, the consumer :
- benefits from a period of two (2) years from the delivery of the goods to act against the seller. This period is reduced to one (1) year for second-hand goods ;
- can choose between repair or replacement of the goods, unless one of these options results in a manifestly disproportionate cost for Komut ;
- is exempt from proving the existence of the defect of conformity during the two (2) years following the delivery of the goods.
To benefit from this guarantee, the Buyer must notify the defect to Komut within a period of two (2) months from its discovery.
The legal guarantee of conformity applies regardless of any commercial guarantee possibly offered on the product.
Even when the manufacturer intervenes to carry out a repair or replacement, Komut remains solely responsible towards the consumer under the legal warranty.
The legal conformity warranty applies regardless of any commercial warranty possibly offered on the product.
7.2.2. Warranty for hidden defects
In the case of a hidden defect, the Buyer has the rights provided by articles 1641 to 1649 of the Civil Code, allowing them in particular to return the item or to request a price reduction.
7.3. Exclusions
Contractual warranties do not cover:
- the abnormal or non-compliant use of the products. We invite you in this regard to carefully consult the user manual provided with the products,
- the defects and their consequences related to non-compliant use for the purpose for which the product is intended
- the defects and their consequences related to any external cause.
8. Customer feedback and comment
The following rules specify the conditions under which the Buyer can submit or use a customer review on the Webshop. These rules complement the terms of use of the Webshop as well as the privacy policy and apply to all users.
By consulting and submitting content on the Webshop, the user agrees to comply with all the terms and conditions of these rules.
8.1. How to write a review on our webshop
Komut takes pride in ensuring that its customers receive all the information they need to make informed decisions about its products. Komut encourages all Buyers to share their product experience, but also to adhere to these simple guidelines:
Any review must:
- reflect your honest opinion
- whether it is positive or negative;
- be precise - establish facts;
- be consistent - focus on certain specific features of the product and your experience with the product;
- be brief.
Your review must not:
- be obscene, unpleasant, offensive or malicious;
- be defamatory or constitute an act of harassment towards another person;
- be subject to identity theft or misrepresentation of your identity;
- contain the name, contact details of another person or any other personal data relating to another person;
- contain advertising or promotional material or links to another website;
- contain material created by another person or that infringes the rights of another person;
- contain details regarding the price or availability of the product;
- contain comments regarding another customer's review.
These guidelines apply to each customer review and must be adhered to in both spirit and letter. Komut will determine at its sole discretion whether a customer review violates these guidelines.
8.2. Use of customer reviews and comments
You will retain all copyright rights related to any customer review you submit on our Webshop.
By publishing a customer review:
- you grant us the right to use, to modify, to alter, to reproduce, to publish and to freely distribute the material contained in your customer review. This permission is free, permanent and may be assigned to a third party at our sole discretion;
- you warrant that your review is entirely original and that it is not taken wholly or substantially from another review and does not violate any of our guidelines (set out above);
- you waive all moral rights or similar rights that you may hold in relation to your customer review, to the extent permitted by law.
The rights you grant us by submitting a customer review on our Webshop imply (without limitation) that we are free to publish all or part of this review, even if you change your mind and ask us to remove it and even if it does not violate our guidelines. Furthermore, we may use this customer review in the context of promoting products and services on our Webshop.
8.3. Violations of the terms regarding customer reviews
Komut reserves the right to refuse, to remove or to modify at its sole discretion any customer review if we believe that it violates these rules and we expressly disclaim any liability for any loss or damage arising from the use of customer reviews by any person in circumstances that violate these rules.
If we consider that a violation of these rules has occurred, we may, at our sole discretion, take these measures if we deem them necessary. Non-compliance with these rules constitutes a substantial violation of the terms of use under which you are authorised to use our Webshop and may lead us to take one of the following measures or all of these measures:
- immediate, temporary or permanent withdrawal of your right to use our website;
- cancellation of any loyalty points earned and banning from our loyalty programme;
- immediate, temporary or permanent removal of any customer review already published on our website;
- issuing a warning against you;
- legal action against you to recover all costs (including, without limitation, our reasonable administrative and legal fees) incurred by the violation;
- further legal action against you;
- disclosure of this information to law enforcement agencies if we deem this measure to be reasonably necessary or required by law.
Komut disclaims all responsibility for any measures we may take following violations of these rules. The measures described above are not limited and we may take any other measures that we deem reasonably necessary.
8.4. Liability
Any customer review or any other material published on our site is provided without any condition or guarantee as to its accuracy. To the extent permitted by law, Komut and the third parties with whom we collaborate, expressly exclude:
- all conditions, warranties and all other terms that may arise from statutory law, customary law or rules of equity ;
- any liability for loss or indirect damage caused by any user and related to our website and to any content published on it, including (without limitation) in the event of loss of revenue, profits, data or goodwill.
These rules will not prevent you from making claims against us in the event of loss or damage you may suffer as a result of a breach of these rules on our part and will not affect our liability in the event of fraudulent misrepresentation or misrepresentation regarding fundamental information nor any other liability that cannot be excluded or limited under applicable law.

9. Retention of title
All products sold remain the property of Komut until the full and final payment of the price by the Buyer.
The transfer of risk occurs only at the moment the Buyer physically takes possession of the goods, in accordance with article VI.44 of the Economic Law Code.
Thus, for purchases made on the Webshop, Komut remains responsible for the product until its actual delivery to the Buyer..
If the Buyer chooses a carrier other than the one proposed by Komut, the risk is transferred to the Buyer at the time of handing over the package to that carrier.
10. Personal data
Komut collects data from its customers through the creation of customer accounts in Stores and on the Webshop. The information collected is solely used to enhance the services offered and the customer experience. It is used, among other things, to:
- Preserve the customer's sales history and ensure the validity of warranties on purchased products.
- Notify them when special orders are available
- Offer them access to rental services, resoling etc...
On the Webshop, the information requested by Komut is essential for managing the Buyer’s order. The Buyer has the right to access, modify, rectify, and delete their data at any time with Komut. They can exercise this right by sending their request via email to the address hello@komut.be.
Depending on the selection made by the Buyer when creating or modifying their account, they may receive information and commercial offers from Komut if they have expressly requested it. The Buyer can, at any time, decide to stop receiving these information and commercial offers from Komut at the bottom of each email received from Komut, or by specifying their request via email to the address hello@komut.be.

11. Intellectual property
All text data, photos, comments, works, illustrations and images reproduced on the site www.komut.be are its property. Therefore, it is strictly forbidden to reproduce, download, copy, or exploit them even partially, for commercial purposes and this worldwide, unless prior agreement from Komut.
12. Liability
The products offered in Stores and on the Webshop comply with the legislation and Belgian standards in force.
Komut cannot be held responsible for the non-performance or poor performance of the contract concluded between the parties in case of force majeure, of an event attributable to the customer or any inconvenience, foreseeable damage or insurmountable issues inherent to the use of the internet.
Komut cannot be held responsible for any indirect damages that may arise from the purchase of the products.
The photographs, graphics and descriptions accompanying the products have no contractual value and therefore cannot engage the liability of Komut.
The Webshop being hosted by an external provider, Komut cannot be held responsible for any interruption of service of the site, occurrence of bugs, inaccuracies or omissions regarding information available on the site or for any damages resulting from a fraudulent intrusion by a third party that has altered the information present on the site.
For all steps of access to the Site, consultation, filling in the forms, placing orders, delivery of items or any other service, Komut has only an obligation of means. Consequently, the responsibility of Komut cannot be engaged for any inconveniences or damages inherent to the use of the internet network (loss of data, of files…) and completely external to the normal care and precautions taken by Komut.
Komut disclaims all responsibility regarding the content of the site or sites to which hypertext links may refer from its own site, not being able to control the content.
13. Applicable Law
These General Terms and Conditions of Sale are governed by Belgian law. The parties will seek an amicable agreement in the event of a dispute prior to any legal action.

In the absence of an amicable settlement, any dispute between parties will be resolved exclusively by the courts and tribunals of the Brussels district (Belgium).
